TERMS & CONDITIONS OF SALE

These terms and conditions regulate the Agreement between "you" the customer and Personalizedtoiletries.com (hereinafter referred to as "Personalizedtoiletries.com"). All goods which appear for sale on the www.personalizedtoiletries.com web site ("the web site") are advertised as invitations to treat, and no offer of sale shall be implied.

By placing an order with Personalizedtoiletries.com you are offering to purchase the goods detailed within that order, which Personalizedtoiletries.com may or may not accept at their sole discretion. If an order is accepted, Personalizedtoiletries.com will send you an e-mail to confirm.

You undertake that all details you provide for the purpose of ordering or purchasing goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the costs of the products you are purchasing.

If for any reason your credit card details are incorrect or there is not enough money in your account or for any other reason the order cannot be processed, Personalizedtoiletries.com will have right to rescind and upon their election to do so, the order will be cancelled.

A number of products represented on Personalizedtoiletries.com are made to order. In this instance, full payment for the goods will be taken in advance as the products are bespoke in nature. Please note that made to order and personalised products cannot be returned except in the event of a fault.

If there are any changes to the details supplied by you, it is your responsibility to inform Personalizedtoiletries.com as soon as possible. Your statutory rights are not affected by these terms and conditions.

LIABILITY
We attempt to ensure that the information available on the web site at any one time is accurate. However, Personalizedtoiletries.com assume no duty to update such information and cannot guarantee that it will be fault-free.

Personalizedtoiletries.com does not accept liability (except as set out below) for any errors and omissions in the presentation of goods on the web site and reserves the right to change information, specifications and descriptions of listed goods and products at any time. Personalizedtoiletries.com will, however, do its best to correct any errors and omissions as quickly as practicable after being notified of them.

Although Personalizedtoiletries.com makes every effort to ensure that our site is free of all malicious software (spyware, viruses etc), Personalizedtoiletries.com cannot be held responsible for any damage or inconvenience caused by malicious software installed on your computer while visiting the website, whether such software originated from the website or elsewhere.

You are required to print a copy of your invoice on which will appear your rights of cancellation in accordance with the Consumer Protection (Contracts Concluded by Distance Communication) Regulations 2000 which you agree to.

The liability section applies only to the extent permitted by law and does not affect your statutory rights.

The copyright, design rights and artwork on the web site belong to Personalizedtoiletries.com. All other intellectual property rights are reserved. This web site is for personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer or sell any information obtained from this web site. You may only download to your personal computer for viewing purposes and print out a number of pages of this web site for your personal use.

Unfortunately, because of the nature of selling via the Internet and product variability, we cannot guarantee that the product colours will be of an exact likeness as seen or as described. Although we strive to portray images in a realistic light, sometimes we are governed by what imagery is available. Product imagery is sometimes displayed in an aesthetic manner (mood shots may be used) and may not necessarily be in conformance with the approved use of such products.

The colours and dimensions of the products portrayed on the site are merely there as a guide. We strive to portray the products as close as we can to their actual colours, but we have no control over your personal computer and its settings. Some products incorporate natural materials (e.g. wood, leather, etc.), which may also vary slightly. Therefore colours of products may vary slightly 'in the flesh' from the colour that is portrayed on the website.

Delivery price in the UK Mainland is on the website. Areas which may incur an additional delivery charge.

In the instance that the product carries an additional charge to be delivered, a member of our customer services team will contact you before the item is dispatched. More details are available on this policy on our delivery page. Many of our smaller products are dispatched via Royal Mail to the above areas and will still maintain the standard delivery status.

We also use your information to process your order; giving delivery details to our suppliers and processing payment through our secure banking facility.

Returns Policy

For Non-Faulty Goods
As the products offered by Personalizedtoiletries.com are by nature personalized and therefore unique to you, we regret that we cannot offer any return of unwanted goods, except in cases of the product itself being faulty. In such a circumstance please contact a member of our Customer Services team on 02085979039 (or email info@personalizedtoiletries.com) and they will instruct you on how to return the items.

All you pay for is the postage cost of returning the goods. For expensive items we recommend that you use a secure delivery method, which requires a signature on receipt, as this insures the package in case it goes missing. The product will remain your responsibility until it has been signed for at the returns address. We do not accept responsibility for products lost or damaged in the post.
Exceptions

We regret that we cannot accept returns on the following non-faulty products:
The products(s) has/have been personalised, made to order or customised in any way.
The packaging or any of the individual product components has been unsealed or damaged.
The non-faulty product does not arrive at Personalizedtoiletries.com in a resalable condition. In this case we will not be able to offer you a refund. We will call you to arrange to send the product back to you and to take payment for the subsequent delivery costs.
The product(s) are toiletries and have been opened.

For Faulty Goods
If the product you have ordered is faulty you have 30 days in which to return it. Parcels or items damaged in transit must be verbally reported to Personalizedtoiletries.com before 3.00pm the next working day following delivery, and also by email within 3 days.

Please contact a member of our Customer Services team on 02085979039 (or email info@personalizedtoiletries.com) and they will instruct you on how to return the items to us. When returning faulty items we may still ask you to return goods yourself. On receipt Personalizedtoiletries.com will reimburse the costs incurred*. Personalizedtoiletries.com shall pay you a reasonable* postage amount for the return of the product. We normally ask that goods are sent back via First Class Royal Mail (Recorded Delivery) but it may be necessary for us to arrange to collect certain items via a courier.
* Please obtain a proof of postage costs so we can reimburse you the full amount.
*Please note that by reasonable we mean any delivery service equivalent to the cost of Royal Mail Recorded Delivery and up to a maximum value of £10. We regret that we will not be able to refund excessive postage costs (for example goods being sent by special delivery or by courier when this is not necessary). If the postage costs are going to exceed £10 please contact us on 02085979039 for further advice.

Exceptions
• If the deadline for reporting parcels damaged during transit is not met we regret that we will not be able to issue a refund or replacement goods.
Refunds.

We will not confirm that we have received your return. After receipt of your goods we aim to issue refunds within 14 working days. The cost of your gift will be refunded to the credit/debit card or Paypal account used to make the purchase. Please note refunds take 5 working days to clear from the point of processing.

Cancellations

If you wish to cancel an order please contact our Customer Services Team on 02085979039. Unfortunately we cannot cancel goods that have already been despatched. This returns policy does not affect your statutory rights.

REFERRALS TERMS & CONDITIONS
By referring a friend to the Personalizedtoiletries.com Referrals scheme, you are acknowledging that you have read and understood these Terms and Conditions. By doing this, you agree to be bound by these terms and conditions.

Because of the very nature of the Referrals scheme, you also agree to allow Personalizedtoiletries.com Ltd to use your details (in this instance your name and your e-mail address) to send e-mails to your friends. You also agree to the limitation of liability for Personalizedtoiletries.com Ltd in connection with the scheme.

1. Any existing Customer or site member of Personalizedtoiletries.com is eligible to take part in the Referrals scheme. You do not have to purchase to become part of the referral scheme.

2. You must only refer Personalizedtoiletries.com to other individuals that you know personally and who, in your reasonable opinion, would wish to receive an e-mail inviting them to apply for a gift voucher from Personalizedtoiletries.com. This would therefore mean that you usually refer a friend or a member of your family. It is not acceptable to e-mail persons who you are not familiar with, or those who you feel would not care to receive a gift voucher.

3. Also, you must not submit group e-mail addresses as a referral or use e-mail mailing lists in making a referral.

4. You cannot refer yourself to the scheme.

5. You can however refer as many people as you like to the programme.

6. You can only refer one friend once. If your friend has multiple e-mail addresses and you refer all of these e-mail addresses, then this is not acceptable.

If in the opinion of Personalizedtoiletries.com (their Sole Discretion), you have complied with these Terms and Conditions; we will send an e-mail to each Friend that you refer to Personalizedtoiletries.com on your behalf. This is providing your friend meets the following terms and conditions:
Your friend has not already purchased products from Personalizedtoiletries.com previously.
Your friend has not already been referred to Personalizedtoiletries.com by a third party.
Your friend is not registered with Personalizedtoiletries.com.

7. Because Personalizedtoiletries.com is committed to protecting its customers' privacy, and complies with the Data Protection Act it cannot notify you if and when it discovers that a Friend is an existing customer. Nor will it tell you which of your friends has or has not redeemed a gift voucher or purchased products from Personalizedtoiletries.com. Likewise, when and if you receive a gift voucher because one of your friends has redeemed their gift voucher, Personalizedtoiletries.com will not notify you of the details of your friend.

8. The gift voucher that is sent to your friend and the one you receive should your friend use their voucher has a minimum purchase restriction and in order for them to redeem their voucher, he or she must have placed an order, with Personalizedtoiletries.com, with a value equal too or greater than £20.

9. The referrals vouchers are promotional in nature.

10. Referrals vouchers (as well as all other promotional vouchers) cannot be used to pay for personalizedtoiletries.com gift vouchers.

11. Promotional Vouchers of any description cannot be applied to orders already placed with us.

12. For every one of your friends that qualify for, and are sent a gift voucher and become a new customer of Personalizedtoiletries.com, Personalizedtoiletries.com will send to you a gift voucher. This gift voucher will have a face value of £5 (or such other amount that Personalizedtoiletries.com determines in its sole discretion from time to time). This gift voucher has a minimum purchase restriction of £20. A friend will only be deemed to have become a new customer for the purposes of these Terms and Conditions at the time he or she places the order with Personalizedtoiletries.com. His or her order value must be equal too or greater than £20 and Personalizedtoiletries.com must ultimately dispatch to that Friend the product(s) under that order. Personalizedtoiletries.com will not send a gift voucher to you unless and until it receives payment from that Friend for the product(s) purchased under that order.

13. If Personalizedtoiletries.com determines in its sole discretion that you have not complied with these Terms and Conditions, it may, immediately and without notice to you, withdraw all benefits to you and your Friends under the Scheme. This includes, without limitation, cancelling or declining to send any and all gift vouchers issued or to be issued to you and to any of your Friends in connection with this Scheme and, by declining to send or stopping from being sent, any Refer-a-Friend e-mails. This is in addition to any other rights and remedies it may have against you.

14. By joining the scheme, you grant to Personalizedtoiletries.com your consent for it to use your name and e-mail address for the purposes of sending an e-mail to your friends. You agree not to use any false e-mail addresses or names for this scheme. If you do then the term above will come into full and immediate effect.

15. By entering the referrals scheme you represent and warrant to Personalizedtoiletries.com that you have an existing relationship (be it of a personal or business nature) with each Friend and that it is your genuine and reasonable opinion that each Friend would wish to receive a gift voucher from Personalizedtoiletries.com. By providing us with the names and e-mail addresses of your Friends, you are affirmatively requesting and authorising Personalizedtoiletries.com to send them an e-mail on your behalf.

16. Every gift voucher issued under this scheme is issued subject to the Gift Voucher Terms and Conditions and will, expire after 8 weeks of the date that Personalizedtoiletries.com sends the e-mail containing the gift voucher to that Friend or to yourself (or such other time that Personalizedtoiletries.com determines in its sole discretion from time to time).

17. To the fullest extent permitted by law, neither Personalizedtoiletries.com nor any of its employees will be liable for damages arising out of or in connection with this scheme. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

18. These Terms and Conditions represent the entire agreement between you and Personalizedtoiletries.com with respect to the scheme.

19. These Terms and Conditions may be amended or modified by Personalizedtoiletries.com in its sole discretion at any time. Any such amendments will be uploaded on to this page. Once this happens, it is your responsibility to review this page for such amendments. For your own information, you should do this periodically from time to time.

20. With regards to Severance, if any provision of these Terms and Conditions is held to be invalid, such invalidity will not affect the remaining provisions.

21. These Terms and Conditions will be interpreted, construed and enforced in all respects in accordance with English Law, without reference to its choice of law rules, and you irrevocably submit to the non-exclusive jurisdiction of the English courts.

REFERRALS SCHEME FAQ's

Q: How many people can I refer?
Ans: You can refer as many people as you like.

Q: What will I receive by entering the Referrals scheme?
Ans: You will earn a £5 gift voucher per person referred as long as they are eligible (see later) & as long as they fulfil their obligations (see later)

Q: When are my friends eligible to receive a £5 gift voucher?
Ans: Friends are eligible as long as they are:
not already site members.
have not been referred to the site before.
not Customers of personalizedtoiletries.com

Q: Why will I not receive a Gift Voucher?
Ans: If you refer a friend who is not eligible because of the reasons detailed above, then they will not receive a gift voucher.

Q: Will you tell me which of my friends have received a gift voucher?
Ans: We cannot tell you which of your friends will or will not receive a gift voucher because we are committed to protecting the privacy of our customers and site members (including you). If you would like to see more information about this, then you can either read our privacy policy or our Terms and conditions.

Q: If I refer my friends, will I receive a voucher?
Ans: Yes you will unless any of the following apply:-
The person you introduced is already a site member.
The person you introduced has been referred by somebody else.
The person you referred has not decided to place an order.
The e-mail address is invalid.

Q: How long have I got to spend my gift voucher?
Ans: The gift voucher you receive is valid for 8 weeks from the date of issue.

Q: How long has my friend got to spend their gift voucher?
Ans: The gift voucher your friend receives is valid for 8 weeks from the date of issue.

Q: Will I receive my gift voucher as soon as my friend redeems their gift voucher?
Ans: Not necessarily. It might take a period of time for you to receive your gift voucher. The reasons for this are as follows:
a) The person who you referred might not spend the gift voucher straight way.
b) The person your referred may order a product with a long delivery time. You will only receive the gift voucher once the order is complete ie. once the order has been delivered and paid for.

Q: How many gift vouchers can I receive in total?
Ans: There is currently no limit to the number of vouchers you can receive. The more friends you refer to Personalizedtoiletries.com on the referrals scheme, the more vouchers you are likely to receive.

Q: Can I use more than one voucher per order?
Ans: The gift vouchers from Personalizedtoiletries.com to you are promotional gift vouchers. Consequently they are restricted to one per order.

Q: Is there a limit to how many vouchers I can use on different orders?
Ans: No. There is no limit of how many orders you can place. For example, if you refer 20 eligible friends, who all redeem their vouchers, then you will receive 20 gift vouchers in return. You can then use these 20 vouchers on 20 orders.

Q: Can vouchers be used on any product?
Ans: The vouchers can be used on most products, as long as the purchase value £20 or over. There are a small number of products on which discount vouchers cannot be used (for example our 'adventure days product range). Referrals gift vouchers cannot be used on any product which states in the description "sorry discount vouchers cannot be used when purchasing this product'.

Q: Can Referrals Gift Vouchers be used when purchasing Standard gift vouchers?
Ans: No. Referrals Vouchers cannot be used when purchasing standard vouchers from Personalizedtoiletries.com.

Q: Can Gift Vouchers received on the Referrals scheme be used in conjunction with other vouchers?
Ans: No Gift Vouchers can only be used by themselves. They cannot be used in conjunction with any other promotional vouchers.

Q: I've a big contact list on my e-mail system. Can I refer all of these people?
Ans: You cannot refer groups of people to the site. You cannot refer mail merged contact lists, or group e-mail aliases. You can however refer these people individually as long as you know them via personal or business contact.

Q: Can you tell me which of my friends have placed orders and whom I am going to receive a gift voucher from?
Ans: No. We cannot tell you which of your friends have placed orders on the site. This again is because we are committed to protecting their privacy.
Registration Gift Vouchers

By registering with the Personalizedtoiletries.com Registration scheme, you are acknowledging that you have read and understood these Terms and Conditions. By doing this, you agree to be bound by these terms and conditions. You also agree to the limitation of liability for Personalizedtoiletries.com Ltd in connection with the scheme.

The following terms and conditions apply to the vouchers received when registering on the website:

1. Any persons using Personalizedtoiletries.com is eligible to take part in the Registration Scheme. No purchase is necessary.

2. Each user is only eligible to receive 1 registration voucher. Any user attempting to receive more than 1 voucher will, at the sole discretion of the directors of Personalizedtoiletries.com, have all of their vouchers nullified and made void immediately.

3. Registration Vouchers have no minimum purchase value.

4. The gift vouchers from Personalizedtoiletries.com to you are promotional gift vouchers.

5. If Personalizedtoiletries.com determines in its sole discretion that you have not complied with these Terms and Conditions, it may, in addition to any other rights and remedies it may have against you, immediately and without notice to you, withdraw all benefits to you and your Registration under the Scheme (including, without limitation, by cancelling or declining any and all gift vouchers issued or to be issued to you)

6. Registration vouchers cannot be used in conjunction with any other Personalizedtoiletries.com promotional voucher be they a moneytary voucher or discount voucher.

7. By joining the scheme, you grant to Personalizedtoiletries.com your consent for it to use your name and e-mail address for the purposes of sending periodic promotional e-mails to you.

8. Every gift voucher issued under this scheme is issued subject to the Registration Gift Voucher Terms and Conditions and will expire after 8 weeks of the date that Personalizedtoiletries.com sends the e-mail containing the gift voucher to you, or such other time that Personalizedtoiletries.com determines in its sole discretion from time to time.

9. To the fullest extent permitted at law, neither Personalizedtoiletries.com nor any of its Directors, or employees will be liable for damages arising out of or in connection with this scheme. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

10. These Terms and Conditions represent the entire agreement between you and Personalizedtoiletries.com with respect to the scheme.

11. These Terms and Conditions may be amended or modified by Personalizedtoiletries.com in its sole discretion at any time. Any such amendments will be uploaded on to this page. Once this happens, it is your responsibility to review this page for such amendments. For your own information, you should do this periodically from time to time.

12. With regards to Severance, If any provision of these Terms and Conditions is held to be invalid, such invalidity will not affect the remaining provisions.

13. These Terms and Conditions will be interpreted, construed and enforced in all respects in accordance with English Law, without reference to its choice of law rules, and you irrevocably submit to the non-exclusive jurisdiction of the English.

Promotional Vouchers
Promotional Gift Vouchers can only be used online at Personalizedtoiletries.com.
Promotional Gift Vouchers have a cash redemption value of 0.001p.
Only one promotional gift voucher may be used per order.
Promotional gift vouchers cannot be used in conjunction with any other Personalizedtoiletries.com promotional voucher or any other gift voucher be it a registration voucher, a monetary voucher or discount voucher.
